SUING THE AT FAULT DRIVER
Yes. If someone else is at fault for the injuries that you sustained in a motor vehicle accident, we can proceed with a claim in court called 'a negligence claim' which is also referred to as a 'tort claim'. This claim takes the form of a traditional law suit filed in the Superior Court of Justice of Ontario. In this process you would be referred to as the 'plaintiff' and the person who is at fault for your injuries would be named as the 'defendant'. This process is begun with the issuing of a Statement of Claim that is drafted by your lawyer, filed with the court registrar, and then served on the defendant or defendants.
