TIMEFRAME FOR BEGINNING LEGAL ACTION
There is a two year limitation period from the date of the incident during which you must begin a court action. After the two years have expired your case will be barred by virtue of the Limitations Act of Ontario18
Only a lawyer can begin a court action for damages in negligence against the at fault driver. Paralegals and other persons, who often act as representatives for persons applying for accident benefits, cannot begin a court action on your behalf.
