STATUTORY ACCIDENT BENEFITS

If you are involved in an incident in which the use or operation of an automobile directly causes an injury or impairment, you may be entitled to a variety of benefits that are set out in an Ontario regulation referred to as the Statutory Accident Benefits Schedule, or 'SABS' for short.1

These benefits are also known as 'no fault' benefits because your entitlement to them is not determined by fault. Whether you are hurt due to the fault of another driver, or are at fault and have caused the motor vehicle accident, you are still entitled to all of the benefits set out in the Statutory Accident Benefits Schedule, subject to a few limited exceptions.

Accident Benefits are obtainable through an application process and do not require the commencement of a law suit or legal proceedings unless they are contested or denied by the insurer. These benefits will be described in detail in section 3 below.
