When such injuries happen on private property, this type of claim is founded in the Occupier's Liability Act1 of Ontario, which establishes a common duty of care owed to all entrants to an occupier's premises. This duty is defined as ' a duty to take such care as in all the circumstances of the case is reasonable to see that persons entering on the premises and the property brought on the premises by those persons are reasonably safe while on the premises.' Actions against municipal bodies may also be brought pursuant to the City of Toronto Act, or the Municipal Act which set out similar duties for municipalities and the properties they control.
